Terms of service

Status: draft, published for review. This document is prepared from how the platform actually behaves, but it has not yet been reviewed by an NZ employment and privacy lawyer and is not yet in force. It is published here so it can be read and corrected — please treat it as a statement of intent, not a contract.

This one is newer than the rest: there was no terms document before, so it has had no review at all. It needs the same NZ employment/privacy lawyer sign-off already pending on the privacy policy, the data processing addendum and the biometric privacy impact assessment.

1. Who these terms are between

These terms are made by ASK YOUR HR LIMITED, a New Zealand company (NZBN 9429051538712, company number 8864748), registered office 15 Bremner Ridge Street, Flat Bush, Auckland 2019 (“we”, “us”).

These terms cover use of the AskHR360 platform at askhr360.com by an employer organisation (“you”) and the people you invite into it.

2. What the platform is

AskHR360 holds employee records, timesheets, leave, documents, training, health & safety reporting and performance reviews for New Zealand employers, and hands payroll-relevant data off to your accounting system.

It is guidance, not legal advice. The platform reflects New Zealand employment and safety law — statutory leave entitlements, 90-day trial period rules, notifiable event duties — and keeps those rates and rules in one reviewed place rather than inventing them. It cannot tell you whether a particular dismissal, restructure or incident is lawful. Decisions about your people remain yours, and for anything contentious you should take advice.

3. Accounts, roles and security

  • The person who registers the organisation becomes its admin and is responsible for who else is invited and at what role.
  • Roles are least-privilege by default: managers do not see IRD numbers, dates of birth, addresses, bank details or salary.
  • You are responsible for the accuracy of what your organisation enters, and for keeping account credentials secure. Two-factor authentication is available to every account and can be required across your organisation — we recommend it.
  • Tell us promptly if you believe an account has been compromised.

4. Your data

Employee records you enter remain yours. Under the Privacy Act 2020 your organisation is the agency for that information and we process it on your behalf; how it is handled, protected and located is set out in the privacy policy, and the data processing addendum in docs/dpa-draft.md is intended to attach to these terms.

You can export your organisation’s full records from the platform, including when you leave.

5. Acceptable use

  • Use the platform for your own organisation's employment administration — not to hold records for unrelated businesses.
  • Do not attempt to reach another organisation's data, probe or interfere with the service, or use it to do anything unlawful.
  • Enrolment in the face-recognition clock must be genuinely optional for your staff, with an alternative available, as required by the Biometric Processing Privacy Code 2025.

6. Fees and billing

Subscriptions are priced by employee band and agreement term, not per seat. A band covers a range of employees — the bands and their prices are set out on our pricing page — and the monthly price for your band is fixed for the term of the agreement you sign. Prices are in New Zealand dollars and exclude GST, which is added at the rate applying at the time of invoice and shown separately on it.

Because the price covers a range rather than a headcount, staff joining or leaving within your band do not change what you pay. There is no nightly re-count and no proration. If your headcount grows beyond the band you agreed, your administrators are notified and nothing is blocked, restricted or charged automatically — moving to a different band is a conversation, not something the system does on its own.

Billing is monthly in advance, and a one-off setup fee is charged on the first invoice. Employee data is never passed to the billing system: the only thing that identifies you to it is an organisation reference, and under band pricing not even a headcount is sent.

If a payment fails, the organisation is marked past due and its administrators see a notice when they sign in. Ordinary staff are not shown it, and nobody loses access at that point — this platform holds employment and health-and-safety records that people may be required to reach, so a failed card does not lock an employer out of its own compliance records.

7. Availability and support

We aim to keep the service available and to fix faults promptly, and we publish maintenance in advance where we can. The platform runs on managed hosting in Sydney, with nightly database and document backups that are verified rather than assumed.

No uptime figure is measured or published, so none is claimed here.

8. The AI assistant

Where your organisation enables it, the assistant answers questions about your own records using a third-party model provider (Anthropic). Your data is not used to train models. The assistant can be wrong, and its answers are subject to the same “guidance, not legal advice” limit as the rest of the platform — check anything you intend to act on.

9. Suspension and termination

You may stop using the platform at any time and export your records. We may suspend an account for non-payment, or where use is unlawful or puts other customers’ data at risk.

You can cancel at any time from the billing page, and you can export your organisation’s full data yourself without asking us. Export does not depend on the account being in good standing.

10. Liability

Nothing is limited or disclaimed here yet. A limitation of liability, and the position under the Consumer Guarantees Act for business customers, will be settled when these terms are finalised. Until then your rights under New Zealand law are unaffected by this document.

We will post changes to this page and update the date below.

These terms are governed by New Zealand law.
